Role boundaries and professional contracting · Lesson 2

Understandable consent and defined confidentiality

4 min read

Lesson objectives

  • Formulate an agreement that clarifies participants, information use, and sharing limits.

Consent is a process of understanding and choice, not a signature that resolves every conflict. Before collecting information, explain the service and its limits, who participates, who can access records, and how information may be used. Ask people to describe their understanding in their own words. Adapt communication for language or literacy needs and use an appropriate interpreter who protects privacy when needed.

In a service involving several people, one person’s consent does not automatically permit disclosure of everyone’s information. Agree on how individual information and joint meetings will be handled before receiving sensitive details. Confidentiality limits, reporting duties, and minors’ consent depend on law and role; verify them locally rather than promising absolute secrecy. A signature obtained while another person monitors the signer is insufficient evidence of free choice.

For competing information requests, use four steps: identify whose information is involved and the sharing purpose; check authority to consent or another lawful basis; compare minimum sufficient sharing with a non-identifying alternative; explain the decision and limits. Fictional example: one parent requests notes from the other’s individual meeting to improve cooperation. Sending notes may harm privacy, while refusing all coordination may lose an agreed practical arrangement. Where rules and appropriate consent permit, share a specific practical agreement rather than meeting details. A binding legal demand cannot be decided by personal preference: seek authorized advice and follow applicable law.

Lesson summary

Consent is ongoing understanding of purpose, participants, and information limits. One participant cannot automatically authorize disclosure of others’ information; agreements change when the service changes.
